World Recent Legislative Affairs Trend(세계 각국의 최신 법제 동향)Ⅰ ▨ The Republic of Kazakhstan –a bill on personal bankruptcy is under discussion 카자흐스탄-개인파산에 관한 법안 심의 A bill on personal bankruptcy is scheduled to be reviewed. It will be enacted by the form of an amendment of the Insolvency Act. 조만간 카자흐스탄 정부는 개인파산에 관한 법안을 심의할 예정이다. 법안은 지급불능에 관한 법률의 개정 형태로 제정된다. According to the related government official, the first version of this bill is subjected to the government at 2008, but the adoption is delayed because of financial crisis and that it is still pending. 정부 관계자의 말에 따르면 1차 법안은 2008년 정부에 상정된 바 있다. 그러나 금융위기로 인하여 채택이 지연됐고, 2011년 봄 개인파산에 관한 법안에 대한 이견에 대한 합의에 도달했으나, 아직 채택되지는 않은 상태이다. An application of personal bankruptcy is decided by the court through requests of the person himself or the bank. The request can be applied in the case of over 50,000 ruble for debts which is overdue for over 6 months. 개인파산에 대한 신청은 본인의 요구 및 은행의 요구가 있을 경우 법원을 통하여 이루어진다. 개인파산에 관한 신청은 6개월 이상 연체된 5만 루블 이상의 채무를 가진 경우에 가능하다. If the debtor declares personal bankruptcy, the process of repayment is planned not more than 5 years and the payment should be fulfilled within the process; it is regarded as being discharged all debts. 채무자가 파산 절차에 동의 할 경우 최대 5년 기한으로 하는 채권자와의 합의를 거쳐 채무의 재상환 계획이 짜여지고, 이 계획에 따라 지불이 원활히 이루어질 경우 채무는 상환된 것으로 간주된다. In the case of not carrying out the process, the person is declared insolvent and his/her assets are put up for auction. The bill prescribes that the household items such as appliances, clothes, shoes etc. not more than 30,000 ruble one cannot be sold. 상환 계획이 지켜지지 않은 경우 해당인을 파산자로 인정하고, 그 재산은 경매를 통해 매각된다. 법안에 따르면, 이 때 3만 루블 이하의 주거용품, 의류, 신발, 가전제품과 기타 물건은 매각되지 않는다. 출처: www.zakon.kz

World Recent Legislative Affairs Trend(세계 각국의 최신 법제 동향) Ⅱ ▨ Uzbekistan – The abolition of category of business for licensing and permission 우즈베키스탄-면허 및 허가 업종의 폐지 On July 16, the President of Uzbekistan signed an executive order about the reduction of business categories to take license and permissions, statistics, revenue and financial report. 우즈베키스탄 대통령은 7월 16일 통계, 세무, 금융 보고서, 면허 및 허가 업종의 대폭 축소 방안에 관한 대통령령을 서명했다. The purpose of this decree is to improve business circumstances by way of removing burea-ucracy obstacles under the international standards and market economy, reduction and simplification of permission process, reform of reports and those submission processes. 이 법령의 목적은 시장 경제, 국제 규정 및 기준에 따라 관료주의적 장애물 철거, 면허, 허가절차의 축소 및 간소화, 보고서와 제출 절차의 근원적 시스템 개선을 통하여 사업환경을 근본적으로 개선하는데 있다. From 1st. August, therefore, about 80 business types for permission and about 15 business types for licensing will be abolished and also licensing period will be prolonged without limitations. From January 1st, 2013, the submission of all kinds of monthly tax reports, except tax of excess earnings, will be abrogated. 이에 따라 8월 1일부터 우즈베키스탄 내 80여개의 허가업종과 15개의 면허업종이 폐지되고 면허기간도 무제한으로 발급된다. 2013년 1월 1일부터는 초과이익세에 대한 세무 보고서를 제외한 모든 형태의 세금에 대한 월간 세무보고서의 제출이 폐지된다. 출처: www.gazeta.ru

	Report on abroad training 국외 출장 보고서 The staff of the Ministry of Government Legislation(MOLEG) including Sang-woo Han in Legislative System Advancement Division Officer participated the 10th International Association of Legislation(IAL) symposium held in Russia last June. 지난 6월 러시아에서 개최된 제10회 세계입법학회 국제학술대회에 법제처 한상우 법제도선진화 담당관 등이 참석하였다. The purpose of this visiting of MOLEG is to collect each country’s information about regulatory innovation trough the symposium, the subject of which is compliance and performance of regulatory innovation and to gather the information for preparing the next 11th International Association of Legislation(IAL) symposium which will be held in Seoul, 2014 and to understand international trend as a co-host of 11th IAL symposium. 이번 법제처 방문단의 러시아 방문은 규제개혁의 이행과 준수를 주제로 열린 국제학술회의 참석을 통해 세계 각국의 규제개혁 관련 정보를 수집하고, 2014년 서울에서 개최될 ‘세계입법학회 서울 대회’(제11회)의 공동 주관자로서 서울 대회 준비에 필요한 자료 수집과 국제적 동향을 파악하기 위한 것이다. The visiting group of MOLEG introduced Ministry of Government Legislation, released promotional materials of Asian Forum of Legislative Information Affairs by using of in the break time of the symposium and dinnertime, so that make the participants understand Legislation of Korea. 법제처 방문단은 제10회 세계입법학회 국제학술대회의 회의 중간, 만찬시간 등을 활용해 법제처 소개, 아시아법제포럼 홍보자료를 제공함으로써 회의 참석자들의 한국 법제에 대한 이해를 제고시켰다. Also the important people such as Legislative System Advancement officer, the president of Korean Society of Legislation and Policies attended in person with considerable interest in the International Association of Legislation(IAL), as a result, they succeeded in hosting the next 11thInternational Association of Legislation(IAL) symposium, in 2014. 또 법제처 법제도선진화담당관, 한국입법정책학회 회장 등 주요 인사가 직접 참석하여 세계입법학회에 큰 관심을 표시함으로써 2014년 제11회 세계입법학회 국제학술회의 유치에 성공하였다. The group of MOLEG visited ‘Legislation and comparative jurisprudence research institution’ of Russia to propose signing of MOU with the institution and agreed to exchange mutual legislative research data of both countries. And also The group of MOLEG visited the Ministry of Justice of Russia, therefore drew contents of the necessity of mutual interchange and co-operation in the legislative sector and confirmed agreements to participate the international forum that is hold by each country. 법제처 방문단은 러시아 ‘입법과 비교법학 연구소’를 방문하여 ‘입법과 비교법학 연구소’의 MOU 체결을 건의하고 양국의 입법관련 연구 자료의 상호 교환에 합의하였다. 또 러시아 법무부를 방문하여 양 기관 간 법제 분야의 교류·협력 강화 필요성에 대해 공감하고 양국이 개최하는 국제회의에 상호 참석을 희망한다는 의사를 확인하였다.
